By accessing or using PingClients ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Description of Service

PingClients provides an automated service reminder platform that helps businesses send notifications to their customers about scheduled maintenance, appointments, and services.

Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • You may not use another person's account without permission

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam or unsolicited communications
  • Upload malicious code or interfere with the Service
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Collect data from the Service without authorization

Your Content and Data

You retain ownership of all data and content you upload to the Service. By using the Service, you grant us a license to process your data solely to provide the Service to you.

You are responsible for ensuring you have the right to upload and use any customer data, including obtaining necessary consents for sending communications.

Payment Terms

  • Fees are charged in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

Intellectual Property

The Service and its original content, features, and functionality are owned by PingClients and are protected by international copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGCLIENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Indemnification

You agree to indemnify and hold harmless PingClients from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance.
